Terms and Conditions of Service

- We make every attempt to conduct a thorough and impartial service, however we make no guarantee, implied or otherwise, that any applicant under any circumstances will be awarded the particular license, rating or service sought.

- In the case of a Flight Test, Flight Review or Instrument Proficiency Check, the applicant must be familiar with the applicable FAA Practical Test Standards and be able to brief the Examiner on them.
- It is entirely the applicant’s responsibility to be both physically and mentally prepared for the flight test or service on the day.
- It is entirely the applicant’s responsibility to provide and ensure the required aircraft is available, airworthy and equipped according to FAA regulations (regardless of country of registration), prepared and that the aircraft and equipment logbooks are on hand for inspection by the examiner. In some cases it is permissible to use a non-US registered aircraft for the flight test but be advised it must meet the minimum US requirement for the flight test and it is the applicant's responsibility to ensure compliance with the local authority's regulations and guidelines. It is entirely the applicant’s responsibility to provide and ensure the required aircraft paperwork is on board the aircraft: (A) Airworthiness Certificate (MUST BE DISPLAYED IN THE AIRCRAFT), (R) Registration Certificate, (R) Radio Station License, (O) Pilot Operator’s Handbook (MUST BE FOR THAT PARTICULAR REGISTRATION ONLY) and (W) Weight and Balance calculations. ARROW- If any one of these items is missing the flight test will be immediately discontinued.
- It is entirely the applicant’s responsibility to ensure the required applications and paperwork are correct. This applies to Flight Tests AND License Validations. The examiner cannot correct it for you. DO NOT POST, FAX OR EMAIL YOUR PAPERWORK TO US unless requested to do so AS THE EXAMINER WILL probably not have time to REVIEW IT UNTIL THE DAY OF SERVICE. The examiner will never accept a blank or incorrectly filled out application. It is entirely the applicants responsibility to ensure that the test aircraft is one of the aircraft that the Examiner is authorized to conduct flight tests in.
- It is entirely the applicant’s responsibility to have with them all current charts and equipment required for the flight test or service. AERAD PUBLICATIONS are unsuitable for flight tests
- It is entirely the applicant’s responsibility to ensure that the aircraft is fully insured to cover both instruction and testing.
- The applicant is Pilot in Command regardless of grade of license sought, registration of aircraft or country in which the flight test is conducted. The applicant will annotate his or her log book accordingly. Never is the flight considered to be Dual.
- The Examiner is NEVER acting as PIC or a required crew member under any circumstance. You hereby agree that any entry in the applicant’s logbook indicating otherwise invalidates the entire entry and is expressly forbidden.
- Flight Tests should not be booked unless all Transportation Security Administration and/or background requirements have been met.
- TRAINING BY NON-FAA INSTRUCTORS: Applicants wishing to credit instruction provided by non-FAA instructors must present to the examiner certified proof that the non-FAA instructor was indeed authorized to conduct such training OUTSIDE THE US ONLY. In addition, logbook entries by the non-FAA instructor must be according to FAA standards and say exactly what training was accomplished and each flight endorsed accordingly in plain ENGLISH. However, the minimum training as indicated in the FAR/AIM still must be conducted by an authorized FAA Instructor. Also, when the FAR/AIM refers to 'AUTHORIZED INSTRUCTOR' it means a properly qualified and current FAA Instructor -BE CAREFUL!
- Scheduling business meetings, holidays, luncheons etc.. on or near flight test day is extremely poor judgment and should be avoided. In any case, it will have no effect on the conduct or duration of the flight test.
- The Temporary Airman’s Certificate issued in the case of a flight test or license validation is valid for 120 days from the date of issue as clearly stated on the Temporary Certificate itself. Occasionally, due to unforeseen circumstances, the process may take slightly longer. In which case temporary extensions may be granted by the New York International Field Unit and will require the applicant to contact them directly. Your new Airman's Certificate information will appear on the FAA's website only after the process is completed and the new permanent Airman's Certificate has been dispatched to you. You should check http://www.faa.gov/licenses_certificates/airmen_certification/interactive_airmen_inquiry/ . RNAV EUROPE LTD bears no liability or responsibility for such delays **See Item 22 below**
- Retakes: In the event of a retake after failure of a previous flight test conducted by this examiner, RNAV EUROPE LTD may require the full flight test fee. In the event that the previous failed flight test was conducted by another examiner, we will most certainly require the full fee and expenses and will conduct a full flight test. In any case, all retakes in which we conducted the failed flight test will require a full flight test and full testing fee and expenses after 60 days of the last failure.
- TESTING IN THE UK If you wish to be tested in the United Kingdom, the UK Department for Transport requires that you produce a signed letter of authorization from the Secretary for Transport. .
- Fees and expenses in GBP's will be agreed upon prior to the examiner's arrival and are due in full on his arrival regardless of paperwork mistakes, expiration of licenses or required documents, lack of preparation on the part of the applicant, aircraft discrepancies or the weather. (note, the examiner never requests payment of any kind prior to test/service date unless the applicant has made a previous cancellation at the last minute. In such cases, the full fee and expenses will need to be paid in full prior to rescheduling)

- RNAV EUROPE LTD requires that the applicant agree to the flight test and/or validation fees plus expenses prior to beginning any part of the flight test or service. Bank transfers must be accomplished within 3 business days of service or all certificates issued will be canceled. RNAV EUROPE LTD is UK VAT registered. Applicants exempt from paying EU VAT must supply company details i.e, Company name, company address & company VAT number prior to service. This information must be shown on the invoice or receipt.
- Note: In the case of an FAA license reissue of any grade, If the applicant's name or nationality has changed or an error such as date of birth was incorrect on the original license and the applicant failed to have it immediately corrected with the Airman Certification Branch, then the applicant will probably have to travel to the States to meet with an FAA inspector. Please don't wait until the DPE arrives to bring this up. Your new license permanent details must be the same as the original and all supporting documentation i.e., Passport, verification letter etc.. must support this. Regardless, by signing this Terms & Conditions of Service, you agree to pay all the DPE's fees and expenses.

FAA Pilot's License - issued under CFR part 61.75 on the basis of a foreign license (also known in the UK as a piggy back license) requires a Biennial Flight Review conducted by a current & authorized FAA Certified Flight Instructor initially prior to first use and 24 calendar months thereafter. It does not in any way, shape or form allow you to fly a US registered aircraft for hire and reward. Also, you may not use the UK IMC rating in a US registered aircraft anywhere in the world, EVER!

In the event that the permanent Airman/s Certificate has not arrived within 90 days of issue, and only after checking http://www.faa.gov/licenses_certificates/airmen_certification/interactive_airmen_inquiry , the applicant must contact Capt Hughston or his representative IMMEDIATELY & certainly prior to the 120 day expiration date of the certificate.
PAYMENT OF EXAMINER FEES AND EXPENSES ARE PAYABLE IN GREAT BRITISH POUND STERLING ONLY! BANK TRANSFERS ARE IN GBP TO GBP.
POSITIVELY NO REFUNDS AFTER THE EXAMINER'S ARRIVAL, TEMPORARY AIRMAN'S CERTIFICATE, DISCONTINUANCE LETTER OR NOTICE OF DISAPPROVAL HAS BEEN ISSUED FOR ANY REASON!
